We serve a large community with thousands of active members from all over the United Stated as well as internationally.

Our Products
We offer a wide range of products. Each product listing represents one unique item which maps to a specific serial number. Therefore, you need to add the items you are interested to purchase individually into your shopping cart when placing an order. Each item is also independently conditioned by its cosmetic rating (multiple grades ranged from brand new to poor) and functionality (i.e. fully functional or defective with the specific issues detailed in the item notes). Real product photos are provided for some items to better illustrate the cosmetic conditions. Our inventory level is very dynamic. It changes minute by minute as we list new items throughout the day and there could be hundreds of active members searching for our products at a given moment. Nonetheless, our inventory and pricing are always kept current on our site.

Shipping & Handling
Purchase orders are usually shipped out within ONE(1) business day upon the receipt of the order but this is not a hard guarantee. For most orders, a shipping and handling fee will be charged. This charge covers not only the shipping cost but also some other order processing labor. The amount varies depending on several factors, including the number and type of products in your order, delivery method, as well as your account standing. If an unauthorized 3rd-paty is involved in processing the receipt of your order(s), a product missing/damage claim during shipment will not be accepted or honored. By default, the shipping does not include insurance. You have to make a request if you need a value declaration and insurance to cover for your shipment. Additional fee applies in this case.

Local Pick Up
You may also choose to pick up your order in person at our facility but you still need to place your order online and present us the order number when you come to pick up. For most local pickup orders a handling fee still applies, as described in the Shipping & Handling Section above, but excluding the shipping cost.

Cosmetic Grading
We strive to describe each item as accurately as we practically could, on the functional, aesthetic, and other conditions. Nonetheless, for cosmetic rating, it presents an unique challenge in that the process involves subjective assessment and evaluation. Although we believe our rating is mostly accurate and fair, given the large number of devices we process daily as a wholesaler, inevitably some items at times may look significantly better (or worse) than others even they receive the same rating. Such subjectivity (or bias) nevertheless falls on both sides and thus will be considered as normal product variance. Generally speaking, our LIKE NEW and EXCELENT++ will be considered as A grade with no or minimum sign of use, while EXCELLENT and VERY GOOD map to B grade with moderate body wear. GOOD and FAIR graded items will show significant body wear and are C stock. If the target device has any functional issue(s), a corresponding issue icon will be raised and a detailed description will be provided in the item-specific page.

Q:
Do you guarantee cell phone battery capacity?
A:In our test plan, we make sure batteries charge and discharge properly. Unless stated in the item notes, our phones are used and not refurbished. The products we offer are original (not refurbished) and because batteries do decay naturally over time, we do not guarantee the residual battery capacity percentage. Please make your purchase decisions accordingly.

Q:
How do you test your phones and what should I expect for the qualities?
A:All items pass our rigorous functional test and we disclose all issues, if any, that manifested in the QA process. Nonetheless, we are a B2B wholesale distributor, there will be very small percentage of items showing issue(s) that were not previously shown or identified. So we do not claim that 100% of our items will be retail-ready. This will be considered as a normal variance of our offering. But we do offer a 30-day warranty, so if issues arise, you may choose to request for an RMA to send items back.

Q: If I am not satisfied with an item, can I receive a refund?
A: We offer a 30-day warranty. To receive any refund, whether full or partial, you must return the item(s) in question regardless of the reason for return. Because our products are mostly used, volume/bulk buyers might occasionally find that not every item fully meets expectations. In such cases, you are welcome to request an RMA to send the item(s) in question back for refund. If you send back any items that are out of (30-day) warranty, or if the item(s) not in the original condition, the return will automatically be considered and processed as trade-in. The member shall be responsible for the cost of shipping the item(s) back.

Claims and Returns
RMA & Return: All merchandise return needs to receive an RMA approval prior to being shipped back. We offer a 30-day warranty for all items we sell that are rated fully functional (e.g., FULL_FUNC). We cover (cell phone) activation problems (for only the advertised carrier) and functional defects that arise as a result of normal use of the product only. We do not warrant any of (but not limited to) the following conditions: A) Usage compatibility with phone service providers not identified on the (cell phone) listing, B) Battery charge time and battery capacity (unless the item is sold as NEW), C) Damage caused by an exposure to water, D) Damage caused by excessive heat, E) Damage caused by improper use of an adaptor/charger or voltage, F) Any software-related issues due to an user upgrade or installation, Any other physical damages caused by dropping or improper use of force applied to the item. Repair stock items (i.e. ones with major functional issues) are sold as is. Although most repair-stock item is complete (e.g., with cover, battery) but we do not guarantee that and there will be no return or refund on such items. Aesthetic condition is also NOT covered by the warranty and all units returned must in in their original physical condition and no (hardware or software) alteration performed to the device. For all returns, the refund shall not exceed 100% of the product cost. No consequential costs will be covered and paid. A return not covered by our warranty as stated above will be rejected or subject to a $5 (or 15% if greater) restocking fee and the shipping and handling charge will not be refunded. Accessories unless returned in original condition and packaging are not refundable. If an item is returned beyond the 30-day warranty period, the return if accepted will be considered as a trade-in and we will apply our purchasing policy and price to buy back the item. For all merchandise returns, regardless of the reasons for the return, buying members shall be responsible for the return shipping cost. A very high return ratio is subject to account reviews and some member privileges could be adjusted accordingly.

Product Damage or Missing Upon Arrival Claim: ALL claims pertaining to product damage or missing upon arrival shall be reported to digiCircle within 24 hours upon the delivery. Otherwise, such claims will not be accepted.

Repair Stock: digiCircle is a wholesale distributor and we carry a large set of products including repair stock (ie items listed with one or more functional defects identified). We have a very rigorous QA process and we strive to make sure we reveal all the necessary details for the issues detected in the QA process. The item notes however serves as a guide and we do not guarantee the total accuracy nor the completeness of any/all potential defects. As a matter of fact, some defects could be dynamic or progressive over time thus practically not detectable under certain circumstances. In addition, unless stated, (removable) accessories (including but not limited to SIM tray, S-pen, and watch bands) may or may not be included in repair stock items. The repair stock is significantly discounted and therefore it could be financially rewarding to buy such items. However, there will be risks. As a buyer, you will have to factor such financial risks into your decision-making process and place your orders accordingly. Repair stock is sold as is, and not covered by the RMA. A forced return could negatively impact your membership privileges.

Delivery Confirmation: digiCircle only partners with major shipping carriers such as FedEx, UPS and USPS. When the carrier confirms a successful package devlivery to the intended address provided by you, or if you change or redirect the shipping address without digiCircle's acknowledment and approval, digiCircle shall not be held liable for any loss claim for the package. In conjunction with the limitation of warranties as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services during the 30 days preceding the above mentioned claims. digiCircle will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our services or products, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.

Membership & Disclaimers
Membership: digiCircle operates a membership-based B2B platform and each member is considered as a business partner. As such, each membership is unique and could be eligible for a different set of privileges and services. In addition, digiCircle membership is subject to periodic reviews and digiCircle reserves the right to terminate or change any membership status or privileges at its discretion at any time. Each business or individual is allowed to have only one account. Placing an order is considered as an agreement to the Membership Policies outlined above. Refusal for compliance to the Membership Agreements, false claims, excessive product returns and/or cherry picking, repeated decommitments to orders, as well as any other conducts that are fraudulent, abusive, coercive, profane, unamicable, or unprofessional in nature are subject to a membership privilege restriction or revocation. Term of Use
This Term of Use outlines the agreement (hereafter referred to as "Membership Agreement" or "Agreement") applies to any purchase or sell order you with digiCircle (hereafter also referred to as "We" or "Company") and the use of all other services provided by the Company. 1)Member agrees to observe and obey all federal and state rules and regulations regarding personal data security and responsible recycling.
2)Member is aware that, in purchasing used phones and electronics from Digicircle.com, you are obliged to report to Digicircle.com immediately in the event that you discover a device purchased from Digicircle.com that contains personal data. If Member is able to rebuild and/or revive a device or part of a device that previously had not functioned and subsequently find it to contain personal data, Digicircle.com must be contacted immediately. Devices and/or components in question can not be resold or used to repair or refurbish other devices until Digicircle.com has verified/clear any/all personal data.
3)Member recognizes there are certain inherent risks associated with handling personal and/or confidential data, and Member assumes full responsibility, and further releases and discharges Digicircle.com for any loss, damage or legal action arising out of Member's use of the consumer electronics purchases through Digicircle.com.
4)Member agrees to indemnify, hold harmless and defend Digicircle.com against all claims, causes of action, damages, judgments, cost or expenses, including attorney fees and other litigation costs, which may in any way arise from Member's negligence or inadvisable use such as jailbreaking, rooting, or flashing devices. You also agree to indemnify and hold harmless digiCircle and its affiliates and their directors, officers, employees, from and against all losses, expenses, damages and costs, resulting from any violation of this Membership Agreement or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this Membership Agreement. In such event, you shall provide us with such cooperation as is reasonably requested by us.
5)Any legal or equitable claim that may arise from using Digicircles shall be resolved under California law.
6)By signing up with a digiCircle membership, the buyer or seller (the "Member") represents and warrants that it is in compliance with all applicanble federal, state, and local laws, requlations, and ordinances. The Member agrees to comply with all relevant laws, rules, and regulations in the performance of its obligations under this Agreement. The Member further warrants that it has obtained all becessary permits, licenes, and approvals required to enter into and perform this Agreement. The Member shall indemnify and hold Digicircle harmless from any claims, damages, or penalties arising from the Member's failure to comply with such laws, rules, and regulations.
7)The Membership Agreements and Policies outlined above are subject to periodic updates. You acknowledge and agree that it is your responsibility to review this the Membership Agreements and Policies periodically for any modifications. Your continued use of this site after such modifications will constitute acknowledgment and agreement of the modified terms and conditions.
